Question 1

What are the primary areas of practice for The Schafer Firm?

Accepted Answer

The primary areas of practice for The Schafer Firm are eviction defense, eviction appeals to county court, and tenant's rights. The firm specializes in representing clients facing eviction proceedings at the justice court level, as well as appeals to the county court.

Question 2

What is the typical process in a justice court eviction trial?

Accepted Answer

In a typical justice court eviction trial, the judge will ask the plaintiff (the landlord) the cause for eviction, such as non-payment of rent, lease violations, or holdover. The defendant (the tenant) will then have about a minute to explain to the judge why they should not be evicted. It is critical that the defendant be able to articulate their defense clearly and concisely to the judge.

Question 3

What is the difference between an eviction trial in justice court and an eviction appeal in county court?

Accepted Answer

In an eviction trial in justice court, the proceedings are typically brief, and the rules of evidence do not apply. In an eviction appeal to county court, the parties will conduct a trial in front of the assigned county court judge as if it is the first time the case is being heard, and the rules of evidence now apply.

Question 4

What are the typical requirements for a retainer agreement with The Schafer Firm?

Accepted Answer

Retainer agreements with The Schafer Firm typically require payment up front and in full. This applies to both eviction defense cases at the justice court level and eviction appeals to county court.
